1. The affidavit-of-service filed in Court today is taken on record. Despite service, the municipality and other respondents are not represented.
2. Alleging illegal construction at the behest of the respondent Nos. 10 to 13, the instant writ petition has been filed. The petitioner would allege that illegal construction is being carried out at premises No. 114, Rabindrapally, Block-A, P.S.- Patuli, Kolkata 700086. Today, the learned advocate for the petitioner has placed before this Court a notice/order dated 23rd December, 2025 issued by the municipal authorities. He would submit that though the municipal authorities have initiated proceedings under Section 400(1) and 416 of the KMC Act, 1980 (hereinafter referred to as the said Act) such proceedings are yet to reach finality. Let a copy of the aforesaid notice as placed before the Court be taken on record.
3. Having heard the learned advocate for the petitioner and noting that municipality has already initiated
WPA 15878 of 2024 proceedings under Section 400(1) and 416 of the said Act in demolition case No. 05-D/XII/2025-26 and an interim order has been passed by Special Officer Building on 23rd December, 2025 which in effect requires the persons responsible to disclose diverse documents, I am of the view that the aforesaid proceedings which have already been initiated, unless the same have been already completed, be brought to a logical conclusion on expeditious basis preferably within a period of 16 weeks from the date of communication of this order.
4. Since no affidavit has been called for, the allegations made in the petition are deemed not to have been admitted by the respondents.
5. With the above observations and directions, the writ petition is disposed of.
