Petitioner is directed to serve a copy of the revisional application upon Mrs. Debjani Sahu, learned advocate, who usually appears for the State. Her appointment may be regularized by the concerned Authority in due course. Learned advocate for the petitioner submits that the petitioner is in custody since August, 2021. Charge-sheet was submitted on December, 2021. Charge was framed in June, 2023. Out of 18 witnesses cited by the prosecution, till date only two witnesses have been examined.

Having regard to the fact that the petitioner is in custody for about 22 months, I am of the view that the anxiety expressed by learned advocate for the petitioner is justified. It has been informed that the next date is fixed on 4th August, 2023. Learned trial Court is directed that henceforth, the trial Court will fix the schedule consisting of two dates and fix the schedule once in a week so that the trial of the case can be

taken place to its logical conclusion within a reasonable period of time. No unnecessary adjournment shall be granted to any of the parties. The Public Prosecutor conducting the case shall produce the material documents and exhibits on the date so fixed for examination of the witnesses.

In case any of the witnesses are reluctant to appear and they belong to the government department, the learned Special Court would directly communicate to the Superintendent of Police/Commissioner of Police of the concerned district of the area who is supposed to maintain a register regarding the progress of NDPS trial. All stakeholders must cooperate with the learned trial Court so that the trial is concluded at the earliest.

With the aforesaid observations, the revisional application being CRR 2320 of 2023 is disposed of. Pending application, if any, also stands disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
