The petitioner is aggrieved that Pension Payment Order issued to him dated 19th November, 2009, indicates that he has been paid in terms of ROPA, 1998. The petitioner retired from service on 30th November, 2009. The petitioner claims entitlement to pay scale in terms of ROPA, 2009.

In that view of the matter, the District Inspector of Schools (SE), Hooghly shall consider the writ petitioner's representation treating the said writ petition as such and issue appropriate recommendation, after considering the entire records to the Director of Pension and Provident Fund, West Bengal.

In the event for the same reason, the District Inspector of Schools (SE), Hooghly is of the view that the petitioner is not entitled to pay of scale as per ROPA, 2009, a reasoned order may be passed and communicated the same to the petitioner.

The aforesaid exercise shall be completed by the District Inspector of Schools (SE), Hooghly within a period of two months from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
