Mr. Angshuman Chakraborty .... For the Petitioners Learned counsel for the petitioners submits that charge sheet has been submitted against the petitioners and six others under Section 14A (b) of the Foreigners Act besides other provisions and they are in custody since 16th August, 2022. Out of the remaining six accused the case has been filed for ever in respect of Fatema Bibi and filed for the present in respect of accused Shidul Sekh. Warrant of arrest is pending against the remaining 4 accused for which trial of the case cannot be proceeded with. The petitioners seek expeditious disposal of the case (G.R. no. 3546 of 2022 pending before the learned Additional Chief Judicial Magistrate, Barasat, North 24 Parganas).

In view of the fact that the petitioners are languishing in custody for about 2 years without trial, this Court is inclined to hold that the learned Additional Chief Judicial Magistrate, Barasat, North 24 Parganas be directed to exhaust the process for ensuring appearance of the remaining four accused before the Court and proceed with the trial of the case as expeditiously as possible, in accordance with law.

The revisional application being CRR 2444 of 2024 is disposed of.
