1. Fresh affidavit of service filed. Let it be taken on record.

2. Learned counsel submits that the opposite party has duly been served. However, no representation on behalf of the opposite party.

3. Present petition has been filed for transfer of Matrimonial Suit No. 96 of 2024 from the Court of District Judge, South 24 Parganas at Alipore to the court of learned District Judge at Howrah.

4. Learned counsel for the petitioner submits that other proceedings for maintenance and proceedings under Section 498A of the IPC are pending at Howrah Court.

5. The opposite party has chosen not to appear despite being served.

6. Thus, taking into account the facts and circumstances and to avoid unnecessary harassment, the Matrimonial Suit No. 96 of 2024 is withdrawn from the court of learned District Judge, South 24 Parganas at Alipore and assigned for trial in accordance with law to the court of competent jurisdiction under the learned District Judge, Howrah.

7. Transferor court is directed to send entire case record to the transferee court.

8. Copy of this order be sent to the transferor court and the transferee court.

9. Copy of this order be also served upon the opposite party and the learned advocate representing the opposite party.

10. The petition stands disposed of. All connected pending applications, if any, stand disposed of.

11. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
