Sanjit Biswas @ Khude v. State Of West Bengal
August 18, 2025 19 ARDR CRM (M) 940 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, filed in connection with Krishnaganj Police Station Case No. 462 of 2024 dated 24/11/2024 under Sections 329(3)/117(2)/118(2)/103/3(5) of the BNS, 2023.
And In Re :
Sanjit Biswas @ Khude ... Petitioner.
Adv. Atis Kumar Biswas, Adv. Jyoti Agarwal, ... for the petitioner.
Adv. Bitasok Banerjee, Adv. Sachit Talukdar, ...for the State.
Learned counsel for the petitioner submits that the petitioner is in custody for about nine months. He is not the principal assailant. Charge sheet has been submitted. He prays for bail. Learned counsel for the State opposes the prayer. I have considered the material on record.
The FIR has been lodged by the deceased who subsequently succumbed to his injuries. Though he has stated that one Achinta Biswas dealt the fatal blow on him and the others also assaulted him, his wife who is the eye witness to the incident has specifically named the petitioner besides the other accused as the person who has dealt the fatal blow. The offending weapon has been recovered from the house of the petitioner.
Considering the gravity of the offence and involvement of the petitioner therein, prayer for bail is rejected at this stage. The application for bail is disposed of.
Case Diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
