Petitioner is aggrieved by the fact that the representation which was submitted before the Superintendent of Police, Krishnagar Police District on or about 31.05.2024 was not acted upon. The dispute was in respect of a life insurance policy, the claim of which was made by the mother of the petitioner as well as the petitioner. According to the petitioner, police authorities pressurised him for paying the amount. Petitioner complains that he has been illegally called at the police station and has been subjected to immense mental pressure. Petitioner further complains that his house has been ransacked and to that effect, certain documents have been enclosed.

State has submitted a report which reflects that information was furnished by Arati Rani

Mondal, respondent no.7 herein, pursuant to which steps were taken by the police authorities and a case being Kotwali Police Station Case No. 522 of dated 17.05.2024 was registered for investigation. Report also reflects that cheques, which were issued by the petitioner in favour of the mother i.e. the respondent no.7, were stopped by him after informing the bank, as such payments were not received.

Be that as it may, petitioner's main grievance is against the overaction of the police authorities. Since a representation was made before the Superintendent of Police, Krishnagar Police District, the Superintendent of Police, Krishnagar Police District will assess the genuinity of the allegations by an authorized officer of his choice and inform the petitioner regarding the outcome of his findings particularly with regard to whether any excesses have been inflicted upon him.

So far as the cheques are concerned, if there are any other cases pending, the same would not have any influence or impact until and unless any finding is arrived by the Superintendent of Police, Krishnagar Police District.

With the aforesaid observations, the writ petition being WPA 15905 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
