Accordingly, his client would not like to press the same and would file an appropriate application on the self-same grounds.

Accordingly, the application is dismissed as not pressed.

However, this order shall not preclude the petitioner for filing a proper application afresh on the self-same grounds.

The interim order stands vacated.
