The grievance of the petitioner in this writ petition is against the notice dated 1st June, 2023 for proceeding under Section 68F of the NDPS Act, 1985 being annexure P/5 to the writ petition by which petitioner was asked to give personal hearing as well as to file any reply by 8th June, 2023.

Petitioner submits that against the aforesaid notice petitioner has made a representation making prayer for adjournment for one month time for personal hearing in compliance of the said notice by its representation dated 6th June, 2023. Today is 20th September, 2023, so already more than three months time have been expired. So, question of granting any further adjournment for personal hearing does not arise in this case and as such I am not inclined to entertain this writ petition and the respondent

authority concerned will be free to proceed against the petitioner in accordance with law on the basis of the aforesaid impugned notice dated 1st June, 2023. Accordingly this writ petition being WPA 14897 of 2023 is dismissed.
