Report filed by the Hooghly District Primary School Council is taken on record.

By the present writ petition, the petitioner seeks quashing and/or setting aside of the transfer order dated 25th April, issued vide Memo No.232/1(8)/DPSC, Hooghly by the Chairperson, Hooghly District Primary School Council.

Mr. Debapriya Majumder, learned Advocate for the petitioner submits that the petitioner does not intend to press her prayer for quashing of the present order. Rather, she is willing to join her present place of transfer Bali No.1 Primary School under Goghat-II Circle, Hooghly.

In terms of the earlier order dated 19th March, 2026, the Chairperson, Hooghly District Primary School

Council has filed a report stating that the concerned teacher may be allowed to join. However, the absence from 26th April, 2025 till date shall be treated as unauthorised absence as per the existing rules. 5.

Mr. Biswabrata Basu Mallick, learned Advocate for the Hooghly District Primary School Council submits that pursuant to the order of transfer no intimation was received from the concerned teacher about her medical emergency.

The petitioner has lodged harassing criminal complaint against the SubInspector of School, Pandua Circle and the Chairperson, Hooghly District Primary School Council. Be that as it may, there is no embargo for the petitioner to join but the absence will be treated as an unauthorised absence.

It is placed on record in the present writ petition there is no such prayer pressed into service for sanctioning of leave in respect of the absence of the petitioner from the school from 9th January, 2025 till date. Be that as it may, since the petitioner is willing to join her present place of transfer, respondent No.3, Chairperson, Hooghly District Primary School Council is directed to allow the petitioner to join her present place of transfer.

So far as the question of unauthorised absence is concerned, it is left open to the petitioner to approach the authority concerned for redressal.

With the aforesaid direction, the writ petition being WPA 14902 of 2025 stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

10. Interim order, if any, stands vacated.

11. All connected applications, if any, stand disposed of.

12. There shall be no order as to costs.

13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
