Mr. Sudipta Dasgupta Mr. Sondwip Sutradhar ..for the petitioner Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee ..for the State Mr. Ratul Biswas Mr. Koushik Chowdhury ..for the Board The petitioner claims that he filed an application for OBC-B certificate before the date of advertisement which is at page 15 of the writ application. It is dated 23.08.2022 when the advertisement was published on 29th September, 2022. When the application has not been rejected and it has been granted at later stage I think that it is to be held that the OBC-B certificate was issued on the date of application. However, the petitioner could not produce the OBC-B certificate as he received it on 30.03.2023 and he could not produce it at the time of filing of application of TET 2022 that is why he has been declared as unqualified.

I direct the Deputy Secretary to give an opportunity of hearing to the petitioner whether he can

be declared as a successful candidate or not. The petitioner shall produce all documents for participation in the recruitment process on the date of hearing. The petitioner submits that as he was declared as unsuccessful he did not apply for any recruitment process.

This aspect has also to be considered by the Deputy Secretary and he will pass a reasoned and speaking order and communicate the same to the petitioner by two weeks from the date of hearing. The petitioner shall carry all original documents on the date of hearing.

With the above observation and direction, this writ application is disposed of.
