1. The appellant initially filed an application for expeditious disposal of the appeal. The prayer was allowed on 13th July, 2023. We directed the appellant to remove the defects and to file written notes of submission.

2. The appellant is not represented today, nor any accommodation is prayed for on behalf of the appellant.

3. We have heard Mr. Subir Sanyal, learned Counsel for the District Primary School Council, Howrah and have carefully perused the order passed by the learned Single Judge. It appears that the appellant secured 20.62 marks and the lowest cut-off marks indicated in the impugned order is 23.26. As rightly observed by the learned Single Judge that even if the cut-off marks had been 24.13 as recorded in the Memo dated 1st July, 2015, the petitioner could not have emerged as successful candidate.

4. Under such circumstances, the appeal stands dismissed. However, there shall be no order as to costs. (Uday Kumar, J.) (Soumen Sen, J.)
