D/L 57 Ct.No.28 SKB (Rejected) C.R.M. (DB) 2595 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with S.C. No.116 of 2021 arising out of Bankura P. S. Case No.94 of 2021 dated 07.06.2021 under Sections 325/326/307/34 and adding Section 302 of the Indian Penal Code.

In the matter of : Tapan Gorai .... Petitioner Mr. Soumik Ganguli ... for the Petitioner Mr. Zareen N. Khan, Md. Kutubuddin ... for the State Petitioner is in custody for more than two years. He prays for bail.

Learned advocate for the State opposes the prayer for bail. He submits the report.

We have considered the materials on record. From the report it appears witnesses were present. Statement of witnesses disclose involvement of the petitioner in the matter.

Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.

We request the trial court to expedite the trial and conclude the same at an early date preferably within a period of one year from the date fixed for recording evidence without granting unnecessary adjournment to either of the parties.

Parties shall communicate a copy of this order to the trial court for due compliance.
