Nag ..for BMC The petitioner on an earlier occasion approached this Court by filing WPA 4215 of 2024 (Jyoti Gupta vs. Biddhannagar Municipal Corporation & Ors.) for demolition of an alleged unauthorised construction at plot no. AC-91, Seector-I, Salt Lake City, Kolkata700064. A coordinate Bench of this Court by an order dated May 1, 2024, directed the petitioner to make an appropriate representation before the Municipal Biddhannagar Municipal Corporation and the Corporation was directed to consider the same in accordance with law.

The petitioners have again filed this writ petition with a prayer for demolition of the same construction. Learned advocate appearing for the Bidhannagar Municipal Corporation submits that in compliance with the order dated May 1, 2024, the petitioners made

a representation before the Corporation, and following the said representation, the Corporation has already initiated a proceeding under Section 216 of the West Bengal Municipal Corporation Act, 2006.

Having regard to the aforesaid, I am of the view that the present writ petition is not maintainable. Accordingly, WPA 15934 of 2024 is dismissed.
