Petitioner is directed to serve a copy of the revisional application upon Mrs. Faria Hossain, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. The subject matter of the case goes back to the earlier case of Bhadreswar P.S. Case No. 588 of 2022. I have considered the submission of the learned advocate appearing on behalf of the petitioner and I am of the opinion that in the fitness of circumstances, petitioner be granted liberty to take out an application under Section 239 of the Code of Criminal Procedure before the jurisdictional court.

The learned trial court would consider the contention advanced by the petitioner in the application in its true and proper perspective and pass its order independently without being influenced by any observations made by this court.

With the aforesaid observations, the present revisional application being CRR 2330 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
