1. Learned counsel appearing on behalf of the petitioner submits that apart from the statement of co-accused, there is no other incriminating material available against the petitioner. Charge-sheet has been submitted.

2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that there is a statement of a local independent witness who had seen the petitioner hand over a packet to the bus driver from whom the contraband was seized. Additionally, there were calls made between the petitioner and the principal accused.

3. In view of the incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
