Mr. Sengupta, learned advocate for the opposite party no. 1 is present.

Mr. Banerjee, learned Additional Public Prosecutor appears on behalf of the State and produces the case diary. . Learned advocate submits that the investigation of the case is still under progress.

Having regard to the nature of the contentions made in the present revisional application, I find that the petitioner would be at liberty to take such issues relating to facts before the Investigating Officer. Mere civil flavour which has been complained of at this stage when the investigation is in progress would deter the police authority from eliciting the truth. If after the conclusion of the investigation,

Police Authorities are of the opinion that the nature of the dispute is civil in nature it would be at their liberty to come to the aforesaid conclusion.

Accordingly, no interference is called for and the present revisional application being CRR 2000 of 2021 is dismissed. Pending application, if any, are consequently disposed of.
