The present revisional application has been preferred against the judgement and order of acquittal. Learned advocate appearing for the petitioners submits that the same has been wrongly filed. The petitioners intend to challenge such order in appeal.

Liberty is granted to the petitioners to prefer appeal before the appropriate forum under Section 372 of the Code of Criminal Procedure.

Accordingly, the department is directed to return the certified copy to the learned advocate-on-record for the petitioners provided the same is replaced by photostat copy. The learned appellate court will consider if there is any delay and whether the filing of the present revisional application has contributed to such delay.

With the aforesaid observations, the revisional application being CRR 2336 of 2023 is dismissed by treating the same as withdrawn.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
