Mr. Jana, learned advocate appearing for the petitioner submits that as the entire evidence is closed, the present petitioner would be seriously prejudiced.
I have considered the orders which have been enclosed and I find that the present petitioner was, in fact, not cooperating with the court when the evidence was in progress. As a matter of last chance, I grant an opportunity to the petitioner for participating in evidence subject to additional payment of 20% of the cheque amount. Learned court is first to be satisfied regarding the deposit of such amount. Complainant will be granted liberty to withdraw such amount and thereafter evidence would progress and the petitioner would cooperate on the date so fixed before the learned Judicial Magistrate in connection with CR-04 of 2019. With the aforesaid observations, CRR 2339 of 2023 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly
downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
