Petitioner approached this Court for registration of an FIR.
Records reflect that the petitioner filed an application under Section 156(3) of the Cr.P.C. before the learned CJM, Krishnagar, Nadia.
Since the learned CJM, Krishnagar, Nadia has sent the complaint to the concerned police station for treating the same as an FIR, I am of the view that the police authorities were under obligation to register the FIR.
Learned advocate for the petitioner is present.
Learned advocate for the private respondents submits that the petitioner has already appeared and has been granted bail.
As none appears on behalf of State, Mr.
Suddhadev Adak and Mr. Samrat Pal, learned advocates, are directed to represent the State. Their appearance may be regularized by the concerned authorities.
Having considered that substantial time has lapsed and charge-sheet has already been submitted (as has been informed by the respondents), I am of the opinion that in case any further grievance is to be addressed, the petitioner would approach the jurisdictional Magistrate in seisin of the case. With the aforesaid observations, WPA 15992 of 2024 is disposed of.
There will be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
