Kishor Kumar Das v. Union Of India And ORS.
20. 29.07.2025 Court No.08.
(Pritam) WPA(P) 249 of 2025 Kishor Kumar Das.
-Vs.- Union of India & Ors.
Ms. Nilanjana Adhya, Ms. Bishalaxmi Ghosh.
.....for the petitioner.
Mr. Dhiraj Trivedi, Ld. DSGI, Mr. Sushil Kr. Mishra, Ms. Swapna Jha.
....for the UoI.
Mr. Pushpendu Chakraborty.
....for the respondent no.5.
1. Ms. Nilanjana Adhya, learned counsel appears for the petitioner.
2. Mr. Dhiraj Trivedi, learned DSGI appears for the Union of India.
3. On submission, the learned counsel for the petitioner submits that one petrol pump is being constructed in place of other company, which creates confusion in the minds of the people. When it was pointed out that the allotment order was issued on December 25, 2023 as per pleading of petitioner himself, learned counsel for the petitioner submits that construction began in May 2025. The allotment and construction runs contrary to the guideline.
4. In the opinion of this court, there is no public interest involved in this matter and petition appears to have
been filed on behalf of some interested person to block the construction of the petroleum unit.
5. We leave it open for the 'person aggrieved' to challenge it in any appropriate proceeding. Since no element of 'public interest' is involved, we decline interference.
6. Accordingly, the petition is dismissed.
