Counsel for the writ petitioners submits that they have been wrongfully ousted from their residences by the private respondents, who are also residents of a adjacent shanty.

Counsel for the State submits that there are many criminal cases against the writ petitioners registered at Charu Market and Tollygunge Police Stations.

Most petitioners are absconding in the aforesaid cases. It is now well settled that an absconding person is not entitled to relief.

Since counsel for the State submits that production of the bail orders before the police shall suffice, the writ petition is disposed of granting liberty to the writ petitioners to produce appropriate bail orders. If the police is satisfied that the other petitioners, who have obtained bail, are lawful residents of their respective houses, each of them shall be restored to their respective residences.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
