Petitioner submits that earlier in WPA 28909 of 2022 an order was passed on April, 1, 2024. Petitioner submits that thereafter he intended to construct the boundary wall when he found that after construction of the pillars, two pillars have been removed.

Learned advocate for the State has submitted a report. Report reflects that the bank authorities have already taken notional possession and entered into an agreement with a third party in respect of the property concerned. There has been a change of circumstance.

However, the main grievance of the petitioner at this stage is that he sent a representation to the Deputy Commissioner of Police, Barrackpore Police

Commissionerate, but the same was returned to the sender.

Petitioner will submit a fresh representation to the Deputy Commissioner of Police, Barrackpore Police Commissionerate in-Charge of Mohanpur Police Station within a period of seven days. The concerned officer would consider the representation within a period of four weeks and communicate the outcome to the petitioner.

With the aforesaid observations, WPA 15930 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
