Petitioners are aggrieved by the fact that the private respondents have put a padlock on a museum called the Gurusaday Museum.

The brief facts of the said case äre that the said Gurusaday Museum was being managed by a society called the "Gurusady Dutt Folk Art Society" which was funded and managed by the Central Government and the members of the Bengal Bratachari Society. Since after November, 2017 the Central Government withdrew financial support and handed over the management and control of the museum to the Bengal Bratachari Society. This is disputed by the Counsel for the parties. Be that as it may, this Court is of the view that the dispute is primarily private between the petitioner and the private respondents. There is no public element involved in the instant writ petition.

However, since a complaint has been lodged in Thakurpukur Police Station, appropriate enquiry may be conducted and appropriate steps, inter alia, in the nature of 107 proceedings under the Criminal Procedure Code may be taken by the Thakurpukur Police Station and a regular vigil shall be maintained at the locale to prevent any untoward incident and to ensure that there is no breach of peace.

WPA 15948 of 2021 is hereby disposed of without any order as to costs.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
