By an order dated 13th December, 2019 this Court having regard to the facts of this case, directed the parties to attend a mediation. The Mediator has reported vide his order dated 4th December, 2020 that the mediation has failed.
Today, Mr. Dutta, Learned Counsel, appears for the petitioner/the father of the child with Mr. Ghosh, Learned Counsel.
It is submitted that the terms of the compromise order passed by the Learned Trial Court on the basis of a Joint Compromise Application filed by the petitioner/the father of the child and the alleged contemnor/the wife are yet to be honoured by the latter.
The petitioner/the father of the child submits that the matter appears before this Court on
mentioning and, both before and after the mentioning notice was served by e-mail to Learned Lawyers representing the alleged contemnor/the wife. Even personal communication was established with the Learned Lawyers representing the alleged contemnor/the wife to ensure their appearance today. However, none appears to represent the alleged contemnor/the wife today.
Accordingly, in order to give a final opportunity to the alleged contemnor/the wife to assist this Court on the next date through Learned Counsel, let this matter appear under the same heading "For Orders" on the 12th of March, 2021.
The petitioner is granted the liberty to serve notice of this order both on the alleged contemnor/the wife as well as her Learned counsel by physical, postal or electronic modes, as advised and convenient and, produce a comprehensive affidavit-of-service on the next date.
All parties to act on a server copy of this order duly obtained from the official website of the Hon'ble High Court, Calcutta.
