Despite service of notice, the respondents are not represented. Affidavit of service filed in Court today is taken on record.

It is submitted by the learned counsel for the petitioners that despite complaint of assault and dispossession from their land, Gaighata Police has not taken any steps in so far as the petitioners' complaint is concerned.

The O.C., Gaighata Police Station, Bongaon PD has filed a report in the form of instructions addressed to the Government Pleader and the same is taken on record.

It appears from the report that on the petitioners' complaint FIR No.284/20 dated 13th May, 2020 has been registered and has resulted in a charge sheet being Gaighata PS charge sheet No.614/20 dated 28th September, 2020. In respect of further complaint, the proceedings under Section 107 of the CrPC have been taken out against the private respondents.

Gaighata Police shall ensure that there is no breach of peace in the area.

In so far as dispossession is concerned, the petitioners may pursue civil remedies in accordance with law.

With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
