The petitioner challenges a resolution dated May 14, 2025, passed by the Uttar Mokamberia Gram Panchayat.

In compliance with the order dated December 19, 2024, passed in WPA 29223 of 2023, the concerned Gram Panchayat initiated a proceeding pursuant to the petitioner's representation. By the said order dated December 19, 2024, a Coordinate Bench of this Court had directed the Pradhan of the concerned Gram Panchayat to consider and dispose of the representation dated December 20, 2023, after giving an opportunity of hearing to all concerned parties.

The resolution dated May 14, 2025, however, indicates that the Panchayat has not yet taken any final decision. The said resolution records that the Panchayat decided to resolve the dispute amicably

after measuring the relevant land through the concerned Block Land and Land Reforms Officer. Learned advocate appearing for the petitioner assails the resolution dated May 14, 2025, on the ground that the Panchayat failed to determine whether the construction raised by respondent nos. 7 to 10 was made without prior permission from the Panchayat.

It is, however, noted that the resolution dated May 14, 2025, specifically records that the issue relating to the sanctioned plan was not raised by the petitioner before the Panchayat authority at the time of hearing. The resolution further reveals that the dispute between the parties, as canvassed before the Panchayat, primarily revolved around the demarcation of the land being Plot No. 656. It also appears that both parties are in joint possession of the said plot.

At this stage, I am not inclined to interfere with the said resolution, as no final decision has yet been taken by the Panchayat authority. In the event the petitioner is aggrieved by any final decision that may subsequently be adopted by the Panchayat, it will be open to him to challenge the same in accordance with law.

Needless to mention, both parties are at liberty to raise all their respective grievances before the Panchayat authority.

Accordingly, WPA 14943 of 2025 stands disposed of.
