W.P.A. 14958 of 2025 Niyajuddin Sk VS The State of West Bengal & Ors.

Mr. Baidurya Ghosal Mr. Saikat Mukherjee ...for the Petitioner.

Mr. Jayanta Samanta, Jr. Govt. Adv, Ms. Indumouli Banerjee ...for the State.

Affidavit-of-service filed by the petitioner be kept 28.07.2025 Court No. 35 D/L. No.25 Rakib with the record.

Learned advocate appearing for the petitioner apprehends that the property of the petitioner may be vandalized at the behest of the private respondents. To that effect information was furnished before the police authorities, however, the police authorities till date did not take effective steps against the private respondents. Learned advocate for the State is present and submits that the issue relates to mango orchard and there has been a long standing dispute between the petitioner and the private respondents.

Having regard to the nature of the prayers which have been canvassed, I direct that the police authorities not to interfere for establishing the right, title and interest of the property. However, the police authorities would oversee that no untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 14958 of 2025 is disposed of.
