Grievance of the petitioner is that she is being restrained by the private respondent from entering into her matrimonial home. The husband of the petitioner is accused in a criminal case and is currently in jail custody.

There is nothing on record to suggest that the petitioner is implicated in the said case or there is any restrained order upon the petitioner restraining her from entering into the subject house.

Learned advocate representing the State respondents fairly submits before the Court that it is always open for the petitioner to enter into her matrimonial house and the police is not standing in her way to enter in the said house.

In view of the above, liberty is granted to the petitioner to enter in her matrimonial house at VillageAndulia, Post Office-Chowhata, Police Station-Haroa.

If the petitioner faces any resistance or obstruction in entering the house, the petitioner shall immediately intimate the same to the Officer-in-Charge of the police station. The police will assist the petitioner in entering her house.

The private respondent is restrained from interfering with the entry of the petitioner in her matrimonial house.

The writ petition stands disposed of.
