In compliance with the direction passed by this Court on January 18, 2024, Dr. Patra, learned Counsel for the Commission, the respondent nos.3 to 6 herein files a report in the form of affidavit, let it be kept with the record. The petitioner participated in the 9th Regional Level Selection Test, for appointment in the post of Assistant Teacher in the subject category Sanskrit (Pass) medium Bengali under the Physically Handicapped category. He has filed the instant writ petition complaining delay in conducting the medical test to ascertain the percentage of his disabilities. During the pendency of the writ petition such investigation was conducted and the petitioner was found to be below the benchmark disabilities consequently his candidature has been rejected by the Commission.

The petitioner, therefore, is not entitled to the recommendation for the appointment which he is aspiring for.

WPA 14955 of 2023 is dismissed without any order as to costs.
