The petitioners initially challenged the order passed by the District Magistrate and Collector, Murshidabad on 23rd May, 2023 holding them to be illegal encroachers on PWD land and directing them to remove such encroachment and unauthorised construction therefrom and also restore the land to its original condition.

Today, learned counsel for the petitioners submits that the petitioners shall comply with the said order but require some time for their rehabilitation. The petitioners undertake to comply with the order within thirty days from date.

In view of the above, the petitioners are directed to comply with the order dated 23rd May, 2023 passed by the District Magistrate and Collector, Murshidabad within thirty days from date.

The writ petition is disposed of accordingly.

There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
