07.07.2023 tkm/ct 28 C.R.M. (DB) 2610 of 2023 sl no.75 In Re : An application under section 439(2) of the Code of Criminal Procedure And In Re : Chandana Ray ....... petitioner Mr. M Salam Mollah ...... for the petitioner Order dated 2.6.2023 granting bail to opposite party nos. 2 to 4 has been assailed.

Learned lawyer for the petitioner submits that opposite parties were initially enlarged on bail. Subsequently, graver offences were added and warrant of arrest was issued. They were re-arrested. During pendency of investigation, they have been enlarged on bail.

We have considered the impugned order in the light of the aforesaid submissions. Learned judge noted that medical report did not show injury on the neck supporting the allegation of throttling. Order is a well-reasoned one and does not call for interference. Under such circumstances, we are not inclined to entertain the application for cancellation of bail.

Accordingly, application for cancellation of bail is disposed of. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
