Petitioners presently have restricted the prayer for return of the articles which belong to them. So far as the issue relating to possession is concerned, since the civil court is in seisin of the issue, no prayer has been advanced before this Court. Mr. Sengupta, learned advocate appearing for the State submits that Khardah Police Station Case No.296 of 2025 was registered for investigation against the present petitioners and on conclusion of investigation charge-sheet has been submitted before

the jurisdictional court and the petitioners are on bail.

Learned advocate for the private respondent no.8 submits that so far as the materials which are claimed, all the materials do not belong to the petitioners.

Accordingly, petitioners would in connection with Khardah Police Station Case No.296 of 2025 place a list of articles which they intend to take out. A notice be issued to the de facto complainant who has set the law into motion. Learned advocate for the State be heard. In case the learned Magistrate is of the opinion that some of the articles belong to the petitioners, in that case, he will allow the petitioners to take out those articles in presence of the investigating officer or any officer authorized by Khardah Police Station. If it is possible for the learned Magistrate, learned Magistrate would take steps so that whole of the process of hearing of the application after communication of the order be completed within a period of one month.

With the aforesaid observations, WPA 14764 of 2025 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
