1. The petitioner is the father-in-law of the deceased. It is submitted that the grandson is presently in the custody of the grandparents. The petitioner is in no way involved in the commission of the alleged offence.

2. The learned counsel for the State in opposing the prayer has referred to the statement of the neighbours recorded under Section 161 of the Code of Criminal Procedure, post mortem report and the statement of the doctor recorded under Section 161 of the CrPC who examined the deceased immediately after the occurrence.

3. It is, however, submitted that the mother-in-law has been recently enlarged on bail.

4. Considering the materials available in the case diary and having regard to the fact that the victim died within seven

months of marriage and also having regard to the statement of the neighbours and the report of the doctor, we are not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this application for anticipatory bail is rejected.
