WPA 14916 of 2025 Sl.No.

25.07.2025 Court No. 35 G.S.Das Sumanta Bhattacharyya -VsThe State of WB & Ors.

Mr. Z. Ahmed ... for the Petitioner(s) Mr. Vimal Kr. Shahi, ld. AGP Mr. SM Samim Ullah ... for the State-respondent(s) The petitioner complains that he has been ousted from his property by way of forging record of rights. To that effect, information was furnished before the concerned police authorities.

State has submitted a report which reflects that series of cases are still existing and charge-sheet submitted.

Having considered that there is a long standing dispute over the property and the petitioner claims that he has been thrown out from his property and is not allowed to enter into his property, I

am of the opinion that the petitioner will, if so advised, approach the jurisdictional civil court for necessary remedies for establishing his right.

In case, civil court passes any direction upon the police authorities after finally determining his rights, the police authorities would extend aid and assistance to the petitioner.

With the aforesaid observations, WPA 14916 of 2025 is disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to learned advocate for the petitioner.
