The petitioner seeks inter-district transfer from South 24 Parganas to Nadia on her medical grounds.

In the circumstances, the DPSC, South 24 Parganas shall obtain the medical opinion of the petitioner from the CMOH, South 24 Parganas and forward the same along with comments to the Secretary, WBBPE. Upon receipt of the medical opinion of the petitioner and if satisfied, the Secretary, WBBPE shall take an appropriate decision thereon, within a period of 12 weeks from the date of communication of a copy of this order.

The Board shall also ascertain if the medical condition of the petitioner shall be subsisting

as on the date of her entry into service as Assistant Teacher in which case even a medical ground of transfer would be required to be made only after 5 years as per the applicable rules.

The DPSC also send an opinion on the aforesaid to the Secretary, WBBPE.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.
