Since the innocuous prayer of the petitioner who is the de facto complainant in CR Case No.59 of 2016 pending before the learned Judicial Magistrate, Nabadwip, Nadia is for expeditious disposal of the case, the matter may be disposed of without service of notice upon the opposite parties.

Opposite parties shall not be prejudiced if an order for expeditious disposal of the matter is passed in their absence. Expeditious disposal of the matter shall in fact enure to the benefit of both the parties.

Heard learned counsel for the petitioner.

Complaint was lodged by the petitioner on 6th June, 2016 and the accused/opposite parties appeared before the learned Trial Court and were granted bail. Several dates were fixed by the learned Trial Court for evidence before charge. The petitioner prays for expeditious disposal of the matter.

Upon consideration of the submission made on behalf of the petitioner and material on record, the revisional application is disposed of directing the learned Judicial Magistrate, Nabadwip, Nadia to dispose of the case being CR Case No.59 of 2016 pending before him as expeditiously as possible, preferably within one year from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
