Tafijul Mia @ Tafejul Mia v. State Of West Bengal
18.08.2025 Item No.40 Ct.No.34 rc.
Reject C.R.M. (M) 1077 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ratua Police Station Case No. 61 of 2025 dated 29.01.2025. And In Re :
Tafijul Mia @ Tafejul Mia ... Petitioner Mr. Mritunjoy Chatterjee Mr. Imdadul Hoque ... for the Petitioner Mrs. Sukanya Bhattacharjee Mr. Subhajit Chowdhury ... for the State Mr. Sourat Nandy ...for the defacto complainant The petitioner is in custody for more than hundred days and prays for bail.
Learned counsel for the petitioner submits that the petitioner is not the principal assailant.
Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner appears to be a member of a gang which attacked the victim though he is not the principal assailant. The victim lost one of his eyes.
Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The bail application is disposed of.
Case Diary is returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
