The writ petition is directed against an order dated DL-27 05.07.2023 Court No.5 (AD) March 25, 2011 passed in OA-207 of 2010.
By the impugned order, the writ petitioner was found not to be able to produce relevant documents to establish her Indian citizenship for the purpose of appointment to the post of Constable in West Bengal police.
Both the parents of the writ petitioner are Bangladeshi nationals. The writ petitioner disclosed her date of birth as 1988. On police verification, the police did not find any material to suggest, let alone establish, the parents of the writ petitioner entered India validly. Consequently, the writ petitioner was not treated as an Indian national.
The post for which, the writ petitioner participated for selection was for Indian nationals.
In such circumstances, we find no material
irregularity in the department rejecting the candidature of the writ petitioner and the Tribunal rejecting the original application of the writ petitioner.
WP.ST 172 of 2013 is dismissed without any order as to costs.
