The petitioner is aggrieved by the act of the Prescribed Authority and the Block Development Officer, Chapra in issuing the notice of meeting of motion for removal of the Pradhan on the 7th July, 2022.

The specific contention of the petitioner is that the notice of requisition was filed on 26th of June, 2022 and the notice for holding meeting ought to have been issued within five working days.

According to the petitioner, the same was issued on the sixth working day and as such the said notice is bad in law.

Learned advocate representing the State respondents calculates the days and submits that notice was issued on the fifth working day as first, second and third of July were holidays of the State Government.

It appears from the submission of the parties that the allegation that notice was issued on the sixth working day is not substantiated.

In view of the above, no relief can be granted to the petitioner in the instant case.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
