On 6.1.2004 the Special Leave to Appeal under Section 378(4) of the Cr.P.C. was grated. On 20.9.2004 the court observed that the aforesaid application for condonation of delay under Section 5 of the Limitation Act was not filed along with application for the Special Leave to Appeal.
On 30.9.2004, the learned advocate for the appellants was directed to take steps for filing the application for condonation of delay.
On 20.5.2005 the report of the Assistant Registrar revealed that the learned advocate for the appellants did not take any steps to comply with the order dated 30.9.2004 for filing the application for condonation of delay. Till date, no steps was taken on behalf of the appellant to file an application under Section 5 of the Limitation Act.
Accordingly, the instant appeal is not admitted and accordingly, the same is disposed of. Let a copy of this order be transmitted to the learned trial court for information and necessary action.
