Nos.6 & 8 Report filed by the State is taken on record. Learned counsel for the petitioner submits as follows. Although the petitioner was having a valid permit for running a bus for particular route, local miscreants were preventing him from doing so. An application was made by the petitioner under Section 156(3) of the Code. But, it was treated as a complaint. Learned counsel for the State relies on the report and submits that the police have already taken action and initiated a proceeding under Section 107 of the Code against all the parties.

It appears that there is a dispute between the private parties over running of a bus on a particular route. But, the petitioner claims that he has a valid permit for the bus.

In view of the above, let the police authorities keep a sharp vigil at the Bankura Gobindanagar Bus Stand at the time when the bus usually leaves between 9 am to 11.30 am and ensure that no breach of peace takes place. Surveillance shall include frequent visits by police patrol. Therefore, no further order need be passed in this regard.

With these observations, the writ petition is disposed of.

As affidavits were not called for, the allegations made are deemed not to have been admitted.

Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
