Abdul Enam v. Partha Karmakar
22. 01. 2024 BP Sl. 3 Court No. 17 CPAN 865 of 2023 in WPA 6886 of 2019 Abdul Enam Vs.
Mr. Partha Karmakar Mr. Sudipta Dasgupta Mr. Bikram Banerjee Mr. Sutirtha Nayek ..for the petitioner Mr. Saikat Banerjee Mr. Kaushik Chowdhury ..for the Board Copy of the recommendation letter by the West Bengal Board of Primary Education has been served upon the learned advocate of the petitioner. The petitioner alleges that he did not receive any such copy before. However, he went to the District Primary School Council, Paschim Bardhaman but the District Primary School Council intimated him that after receiving the recommendation letter from the end of the Board they would take further steps. As Board has submitted a copy of the recommendation letter today in front of this court, I direct the petitioner to go to the DPSC office immediately with the copy of the recommendation letter and produce the same before the Chairman of the Paschim Bardhaman District Primary School Council. The Chairman, Paschim Bardhaman District Primary School Council is directed to take steps for giving
appointment to the petitioner within a period of ten days from the date of receipt of the said copy of the recommendation letter from the petitioner.
After receiving the recommendation letter, as has been given to him today by the learned advocate for the Board, the petitioner has submitted that this is not the real form of the recommendation letter as is usually given by the Board to the candidates. However, I find from the second paragraph of the recommendation letter that the Board has recommended the name of the petitioner as candidate for appointment to the post of assistant teacher in primary schools in the District of Paschim Bardhaman. This letter has been addressed to the Chairman of the said DPSC. Therefore, I direct all parties to treat this letter dated 10.01.2024 issued by the Board with the heading 'urgent'
as the recommendation letter for all purposes for all times to come and to take steps in accordance with the said letter of recommendation.
Copy of the letter is retained in the record of this case.
With the above direction, the contempt application is disposed of.
