akb Mr. Arabinda Chatterjee Ms. Kakali kutta ...For the Petitioners Mr. Srijan Nayak Ms. Rituparna Maitra ...For the State Respondents This is an application under Article 226 of the Constitution of India wherein the writ petitioners are aggrieved by the inaction on the part of the respondent authorities in considering their representation dated September 07, 2021 for unauthorised plying of vehicles of the private respondent.

I have heard learned counsel appearing on behalf of the parties and perused the materials placed on record. The Secretary, State Transport Authority, West Bengal, being the respondent no. 3 is directed to consider the representation dated September 07, 2021 upon giving an opportunity of hearing to the representatives of the petitioners as also other interested parties and pass a reasoned order within a period of six weeks from date. The reasoned order should be communicated to the petitioners within a period of two weeks from the date of passing of the same.

Needless to mention if the reasoned order is in favour of the petitioners, the authorities are directed to act in accordance with law.

With the aforesaid direction, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
