1. Affidavit-of-service filed in court today be taken on record.

2. Mr. Siddhartha Banerjee, learned counsel appears for the petitioner.

3. Mr. Samrat Sen, learned AAAG appears for the State.

4. During the course of hearing, parties agreed that this petition may be disposed of by directing the Sub Divisional Officer, Kakdeep, South 24-pgs. to decide the representation (annexure p-3) dated January 26, 2025 within stipulated time.

5. In view of consensus arrived at, petition is disposed of with the following directions;

(i) The petitioner shall re-submit the representation (annexure p-3) along with this order before the said Sub Divisional Officer.

(ii) The Sub Divisional Officer shall consider the representation and take a decision on the same within 60 days therefrom.

(iii) It will be open for the SDO to hear the interested parties, if he thinks it fit in the interest of justice.

(iv) If the petitioner's complaint is found to be correct and illegal construction is found, it will be lawful for the SDO to take appropriate steps for demolition and restoration of the same.

6. The petition stands disposed of without expressing any opinion on the merits.
