It appears from the report and is also submitted by the learned advocates for the petitioner as also the private opposite party that the defacto complainant/ opposite party is not willing to proceed with the matter any further in view of the mutual settlement arrived at by and between the parties. In view of the above, this Court is inclined to hold that allowing the proceeding to continue shall be a futile exercise. The proceeding being C.G.R.Case No. 302 of 2022 pending before the learned Chief Judicial Magistrate, Alipore, South 24Parganas be quashed. The petitioner be set at liberty at once and discharged from his bail bond.

The criminal revision being CRR No. 2484 of 2024 is allowed.

The connected application being CRAN No. 1 of 2024 is disposed of accordingly.
