Affidavit of service filed by the petitioners and the report submitted by the Panchayat are taken on record. The petitioners allege unauthorised construction being raised by the private respondents.

It appears from the report submitted by the Panchayat that pursuant to the representation submitted by the petitioners before the Panchayat on 16th June, 2025, the issue has been taken up for consideration and a stop work notice issued upon the private respondents by the Pradhan, Kakra Gram Panchayat on 9th July, 2025. This Court is informed that the issue is still under consideration.

In view of the above, the writ petition is disposed of directing the Pradhan, Kakra Gram Panchayat, being the 6th respondent herein, to consider and dispose of the representation and take necessary consequential steps within two weeks from the date of communication of this order upon granting reasonable opportunity of hearing to

all concerned including the petitioners and the private respondents, in accordance with law.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
