18.07.2022 sdas rejected C.R.M.(DB) No. 2342 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Balagarh Police Station Case No. 130 of 2022 dated 23.04.2022 under Sections 498A/302/304B/34 of the Indian Penal Code.

In Re : Sanku Sarkar ..... petitioner Mr. Sudip Ghosh Chowdhury ... for the petitioner Mr. Saswata Gopal Mukherji, learned P.P.

Mr. Partha Pratim Das Mrs. Manasi Roy ... for the State Mr. Subrato Roy .... for defacto complainant Learned Counsel appearing for the petitioner submits that he is in custody for 86 days. It is also submitted that coaccused (father-in-law of the victim) has been granted bail. He prays for bail.

Learned Counsel appearing for the State opposes the prayer for bail. He submits that the victim suffered unnatural death within four years of marriage. There are allegations of torture over dowry.

We have considered the materials on record. Victim suffered unnatural death within four years of marriage. Statements of witnesses show that petitioner, who is the husband of the victim, had tortured her over dowry.

In view of the aforesaid facts, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
