1. Heard the learned Counsel for the parties. Investigation stated to have progressed substantially.
2. The informant has alleged that he heard the gunshot sound but none was injured and all the present petitioners have been implicated. There is stated to be political rivalry between the informant party and the defence party.
3. Learned counsel for the petitioners submits that so far as petitioner no.1 is concerned there are some past records of criminal antecedent.
4. Regard being had to such facts and submissions, factum of permanent residence of the petitioners, nature of allegation and substantial progress in the investigation, it
is directed that each of the petitioners shall be released on bail in the event of their arrest by the Arresting Officer in the In the Islampur Police Station Case No.230 of 2023 on such terms and conditions including the conditions that (i) each of the petitioners shall appear before the I.O. once in a fortnight on the day and time fixed by the I.O. till submission of final form. (ii) They shall co-operate in the investigation and shall not threaten, induce or coerce any witness of this case in any manner whatsoever during the currency of this order.
5. Accordingly, the prayer for the anticipatory bail is allowed.
6. The application being CRM(A) 2652 of 2023 is disposed of.
7. The concerned Arresting Officer is hereby directed to act upon the server copy of this order.
