An application for addition of party has been preferred by Pratima Jana Mondal. Let the applicant be added as respondent no.4 in the main writ petition.
Accordingly, the application for addition of party being CAN 1 of 2025 is allowed.
Affidavit-of-service filed in Court today be kept with the record.
Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocates appearing for the petitioner and the applicant in CAN 1 of 2025.
Petitioner claims that police authorities have asked him to stop construction and as such being aggrieved has approached this Court.
State has submitted a report which reflects that the police authorities on receipt of the writ petition mainly the SDPO, Baruipur served notice upon the petitioner viz. Khitish Pal for appearing before him on 14.06.2025. It has been categorically observed in the report that no order/direction was passed by the police authorities regarding stopping any construction of house.
The applicant viz. Pratima Jana Mondal claims herself to be a bargadar.
Be that as it may, since this Court is not supposed to decide the right, title and interest of the property, the applicant is formally added without allowing her any interference so far as the merits of the writ petition is concerned.
Accordingly, the writ petition being WPA 15479 of 2025 is disposed of.
There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
